Thinking of selling marijuana in Craigslist? Even if you’re from Colorado, where marijuana can be sold for medical and recreational purposes, selling weed on Craigslist is a big no-no.

Last May, three men from Denver were arrested for marijuana distribution charges as they tried to sell pot on Craigslist. Though there was nothing shady on the way that they obtained weed, reselling them on Craigslist is a different matter.

According to marijuana law and criminal defense lawyer Lauren Davis, “It is not legal to sell cannabis on Craigslist. In fact, it is not legal to sell or trade cannabis for any service or item, period.”

Just because marijuana can be used for recreational purposes doesn’t mean that they are no longer regulated. “The only people who can sell cannabis are licensed dispensaries or a caregiver who provides it to a patient in accordance with the voluminous state rules and regulations,” Davis added.

Those caught trading or selling cannabis on Craigslist are looking at felony charges for distributing marijuana, since it is in violation of criminal law. Police departments can conduct sting operations once they catch someone conducting weed business in Craigslist.

However, Davis clarifies that it is legal to give away marijuana for free.

“It is legal for adults to give away up to an ounce of cannabis without remuneration,” Davis said. “So in other words, you can gift it to someone when that transfer is not part of a tit-for-tat exchange.”
